constitutional responsibility, constitutionals principles of constitutional responsibility, juridical and political responsibility of the head of state, political responsibility of Government, constitutional responsibility and conflict of interests, constitutitionalization and institutionalization of the constitutional principle of government’s members, impeachment, dismissal of head of state, law of ministerial responsibility.
Field of study: Constitutional Law.
Aims and objectives of the thesis. Dissertation is dedicated to the assement of set scientific and practical issues, related to the constitutional responsibility of head of state and constitutional responsibility of government’s members. It is considered to be a complex study of the problems, because it makes a large analysis of national and international legislation and legal practice.
Novelty and scientific originality. There are covered the most actual issues and aspects, which require to be explained for a better understanding and for underlining the importance of constitutional responsibility of head of state, of Government and government’s members, as well as deficiencies and contradictions that are present at the same time in legislation in the respective field, in practical activity and in specialty doctrine.
Teoretical value. A special attention is accorded of the constitutional responsibility, constitutionals principles of constitutional responsibility. The respective constitutional provisions have to be interpreted in the sense that, unlike the MPs, the President of Romania is not tobe held responsible for any deeds, even if they have no relation to the exercise of his mandate.
Implementing of scientific research. This scientific research makes a comparative study of relation of constitutional responsibility - conflict of interests, constitutionalization and institutionalization of the constitutional principle of government’s members. Scientific developments of this thesis can be applied in the legislation-making process and legislation practice, as well as the training aid in education process of the law faculties, on the issues related to the constitutional law.
